Terms of Service

These Terms of Service ("Terms") govern your access to and use of AORDS, including aords.com, AORDS TradingView indicators and scripts, software tools, webhooks, automation functionality, documentation, rulebooks, support services, subscription access, content, and related services (collectively, the "Services").
The Services are operated by AORDS ("AORDS," "we," "us," or "our").
By accessing the Services, creating an account, starting a trial, purchasing a subscription, or otherwise using AORDS, you acknowledge that you have read, understood, and agreed to these Terms.
If you do not agree to these Terms, you must not access or use the Services.

1. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction if higher, to purchase or use the Services.

By using AORDS, you represent and warrant that:

• you have the legal capacity to enter into a binding agreement;

• your use of the Services is permitted under the laws applicable to you;

• all information you provide to AORDS or its service providers is accurate and complete; and

• you are responsible for complying with all laws, regulations, exchange rules, broker rules, tax obligations, and other requirements applicable to your trading activity.

AORDS may refuse, restrict, suspend, or terminate access where we reasonably believe that use of the Services violates these Terms or applicable law.

2. Nature of the Services

AORDS provides software, indicators, trading-related tools, market-analysis functionality, educational materials, historical and backtested analysis, alerts, rule-based methodologies, and related services.

AORDS does not operate as a:

• broker or broker-dealer;

• futures commission merchant;

• commodity trading advisor;

• investment adviser;

• financial planner;

• portfolio manager;

• fund manager;

• bank;

• exchange;

• prop trading firm;

• custodian; or

• fiduciary.

AORDS does not hold or manage customer trading funds.

AORDS does not place discretionary trades on your behalf.

You remain solely responsible for all trading and investment decisions made using information, signals, alerts, tools, automation, webhooks, or other functionality provided through AORDS.

3. No Investment or Financial Advice

Nothing provided through AORDS constitutes investment advice, financial advice, legal advice, tax advice, accounting advice, or personalized trading advice.

Any trading signals, alerts, market classifications, setup grades, contract-sizing examples, opening-range calculations, targets, stop levels, market filters, historical statistics, hypothetical performance information, or other outputs are provided solely for informational and educational purposes.

Nothing provided by AORDS should be interpreted as:

• a recommendation to buy, sell, or hold any financial instrument;

• personalized investment advice;

• a representation that a particular trade is suitable for you;

• a promise that a strategy will be profitable;

• a guarantee of trading performance; or

• an invitation to invest money with AORDS.

You are solely responsible for evaluating whether any trade or strategy is appropriate for you.

4. Trading Risk

Trading futures, securities, derivatives, CFDs, leveraged instruments, and other financial products involves substantial risk.

You may lose some or all of the capital committed to trading.

Leverage can magnify both profits and losses and may result in rapid losses.

Depending on the broker, instrument, account structure, and jurisdiction, losses may exceed your initial deposit.

You should never trade with money that you cannot afford to lose.

Before trading, you should independently evaluate your:

• financial circumstances;

• trading experience;

• objectives;

• risk tolerance;

• capital;

• broker requirements; and

• applicable legal and regulatory obligations.

Where appropriate, you should seek independent advice from a properly qualified financial, legal, tax, or investment professional.

5. Historical, Hypothetical, and Backtested Performance

AORDS may display historical, simulated, hypothetical, or backtested results.

These may include:

• net profit or loss;

• win rate;

• profit factor;

• drawdown;

• setup grades;

• average trade results;

• historical monthly performance;

• trade counts;

• theoretical contract sizing;

• risk-to-reward ratios; and

• other performance-related metrics.

Past performance does not guarantee future results.

Hypothetical and backtested performance has inherent limitations.

Among other things:

• hypothetical results do not represent actual customer trading;

• backtests may be calculated using historical data with the benefit of hindsight;

• actual execution may differ due to slippage;

• commissions and fees may reduce results;

• market liquidity may affect fills;

• order latency may affect execution;

• spreads may vary;

• market conditions may change;

• data quality may affect results;

• broker conditions may differ;

• psychological factors are not represented in backtests;

• user behavior may differ from strategy rules; and

• no backtest can fully replicate real-world trading.

There is no guarantee that any user will achieve results similar to those displayed by AORDS.

Any profit examples, account-growth illustrations, successful trades, statistics, or performance charts are illustrative only.

6. TradingView and Third-Party Platforms

Certain AORDS Services may rely on, integrate with, or be delivered through third-party platforms such as TradingView, Whop, brokers, exchanges, webhook providers, hosting providers, payment processors, or other technology providers.

AORDS does not control those third-party services.

AORDS is not responsible for:

• TradingView outages;

• Whop outages;

• brokerage outages;

• delayed or inaccurate market data;

• webhook failures;

• internet interruptions;

• software bugs caused by third-party services;

• third-party API failures;

• changes to third-party platforms;

• brokerage execution issues;

• rejected orders;

• delayed orders;

• third-party account suspensions;

• exchange interruptions;

• data-provider failures; or

• compatibility issues resulting from third-party updates.

Use of third-party platforms may be subject to their own terms and privacy policies.

7. Accounts and Access

You are responsible for maintaining the security and confidentiality of your account credentials.

Access purchased through AORDS is intended for your personal or specifically authorized business use only.

Unless AORDS expressly provides written authorization, you may not:

• share access with another person;

• rent access;

• sell access;

• sublicense access;

• transfer access;

• distribute access;

• share invite-only indicator access; or

• permit unauthorized persons to use your subscription.

AORDS may suspend or terminate access where we reasonably believe that:

• account sharing is occurring;

• credentials have been compromised;

• access is being resold;

• payment fraud has occurred;

• AORDS intellectual property is being copied;

• access controls are being bypassed; or

• these Terms have otherwise been violated.

8. Trials

Where AORDS offers a free or discounted trial, the duration and applicable conditions of that trial will be shown on the relevant offer or checkout page.

A trial is provided so that you can evaluate the Services before entering a paid subscription.

Unless expressly stated otherwise at checkout, a trial may automatically convert into the applicable paid subscription at the end of the trial period.

If you do not wish to continue with a paid subscription, you are responsible for cancelling the subscription before the trial expires.

Failure to use the Services during a trial does not extend the trial.

AORDS may limit trials to one trial per person, household, payment method, TradingView account, Whop account, or other reasonable identifier.

Attempts to obtain repeated trials by creating multiple accounts, using different payment methods, identities, or email addresses may result in suspension or termination.

9. Subscription Billing and Automatic Renewal

AORDS may offer monthly, quarterly, annual, or other recurring subscription plans.

When you purchase a recurring subscription, you authorize the applicable payment processor to charge your selected payment method:

• when the applicable paid subscription begins; and

• automatically on each renewal date until the subscription is cancelled.

Your subscription will automatically renew unless cancelled before the applicable renewal date.

Subscription prices, billing periods, taxes, trial terms, and other applicable charges will be presented before purchase.

You are responsible for reviewing your subscription details before completing the purchase.

You may cancel future renewal through the platform through which the subscription was purchased.

Cancellation generally prevents the next renewal charge.

Unless otherwise required by applicable law, cancellation does not normally terminate access before the end of an already-paid subscription period.

10. No-Refund Policy

ALL PAYMENTS MADE AFTER THE EXPIRATION OF ANY APPLICABLE TRIAL PERIOD ARE FINAL AND NON-REFUNDABLE, EXCEPT WHERE A REFUND IS REQUIRED BY APPLICABLE LAW.

The purpose of the trial period is to give you an opportunity to evaluate AORDS before becoming a paying subscriber.

Once your trial ends and a paid subscription charge has been successfully processed, AORDS does not normally provide:

• refunds;

• partial refunds;

• prorated refunds;

• account credits; or

• refunds for unused time.

Refunds will not normally be provided because you:

• forgot to cancel the trial;

• forgot to cancel a renewal;

• did not use the Services;

• changed your mind;

• stopped trading;

• were dissatisfied with your trading performance;

• incurred trading losses;

• did not achieve your expected result;

• failed to follow the AORDS methodology or rulebook;

• experienced different market conditions;

• purchased the wrong subscription period;

• no longer require the Services;

• did not connect the indicator to TradingView;

• did not use available features; or

• failed to cancel before renewal.

The same no-refund policy applies to renewal charges.

If your monthly, quarterly, annual, or other subscription renews because it was not cancelled before its renewal date, the renewal charge is generally non-refundable.

You are responsible for cancelling your subscription before the trial expires or before the next renewal date if you do not wish to be charged.

Nothing in this section limits any refund, cancellation, or consumer right that cannot lawfully be excluded or waived under applicable law.

11. Chargebacks and Payment Disputes

If you believe that a charge was made incorrectly, you should contact AORDS or the applicable payment provider before initiating a chargeback.

Fraudulent, abusive, or knowingly false chargebacks may result in immediate suspension or termination of access.

AORDS may provide transaction records, subscription records, access records, acceptance of these Terms, cancellation records, and other relevant information to payment processors or financial institutions when responding to a payment dispute.

Nothing in this section limits your lawful right to dispute a genuinely unauthorized or fraudulent transaction.

12. Pricing

Current pricing is displayed on aords.com and/or the applicable checkout page.

AORDS may change:

• subscription prices;

• plan structures;

• billing periods;

• included features;

• promotional pricing;

• trial offers; or

• discounts.

Pricing changes will not retroactively alter an already-paid subscription period.

Where required by applicable law, appropriate notice may be provided before a change affects a future subscription renewal.

13. Intellectual Property

AORDS and its associated:

• software;

• scripts;

• source code;

• algorithms;

• logic;

• methodologies;

• calculations;

• indicators;

• visual designs;

• graphics;

• branding;

• trade classifications;

• rulebooks;

• documentation;

• written materials;

• videos;

• tutorials;

• datasets; and

• other original content

are owned by AORDS or used under appropriate rights and are protected by intellectual property laws.

Your subscription grants you only a limited, revocable, non-exclusive, non-transferable right to use the Services during an active subscription.

No ownership rights are transferred to you.

You may not, without written permission from AORDS:

• copy the source code;

• obtain or attempt to obtain source code;

• reverse-engineer the Services;

• decompile the software;

• circumvent access controls;

• replicate proprietary logic for commercial purposes;

• distribute the indicator;

• redistribute scripts;

• resell access;

• sublicense access;

• publish proprietary documentation;

• scrape protected content;

• commercially reproduce AORDS functionality;

• provide unauthorized access to third parties; or

• represent AORDS technology as your own.

14. Feedback

If you voluntarily provide ideas, comments, suggestions, feedback, or recommendations concerning AORDS, you grant AORDS the right to use that feedback to operate, improve, modify, and develop the Services without an obligation to compensate you.

15. Acceptable Use

You agree not to use AORDS to:

• violate applicable laws;

• commit fraud;

• gain unauthorized access to another account;

• distribute malware;

• interfere with AORDS infrastructure;

• circumvent subscription controls;

• bypass technical restrictions;

• scrape protected content;

• copy proprietary technology;

• impersonate AORDS;

• misuse AORDS branding;

• mislead other users; or

• assist another person in doing any of the above.

16. Availability and Changes to the Services

AORDS aims to provide reliable access but does not guarantee uninterrupted or error-free operation.

AORDS may:

• modify the Services;

• update software;

• change indicators;

• modify methodology;

• adjust rules;

• update filters;

• improve features;

• change classifications;

• replace functionality;

• discontinue features; or

• release new versions.

Trading strategies and market conditions may evolve over time.

Accordingly, AORDS may update software logic, market filters, configurations, rulebooks, alerts, statistical classifications, and supporting documentation.

17. Support

Where support is included with a subscription, AORDS may provide assistance relating to:

• product access;

• indicator setup;

• software usage;

• technical issues;

• subscription access; and

• product functionality.

Support does not constitute personalized investment, financial, or trading advice.

18. Suspension and Termination

AORDS may suspend or terminate access if you:

• materially violate these Terms;

• fail to pay applicable fees;

• engage in fraud;

• abuse the Services;

• infringe AORDS intellectual property;

• attempt unauthorized access;

• share access improperly; or

• misuse the Services.

You may stop using AORDS at any time and may cancel future renewal in accordance with the applicable cancellation process.

Termination does not entitle you to a refund for an already-paid subscription period except where applicable law requires otherwise.

19. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Services are provided on an:

"AS IS" and "AS AVAILABLE" basis.

AORDS does not warrant or guarantee that:

• the Services will always be available;

• the Services will be uninterrupted;

• the Services will be error-free;

• every signal will be profitable;

• every trade will execute;

• historical performance will continue;

• a particular win rate will continue;

• a particular drawdown level will be maintained;

• the software will meet every user's expectations;

• automation will execute every instruction;

• brokers will execute at displayed prices;

• market data will always be accurate; or

• any particular financial result will occur.

Nothing in these Terms affects rights or warranties that cannot lawfully be excluded.

20. Limitation of Liability

To the maximum extent permitted by applicable law, AORDS and its owners, contractors, employees, service providers, and affiliates will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages.

This includes, without limitation:

• trading losses;

• investment losses;

• lost profits;

• lost business opportunities;

• account drawdowns;

• loss of data;

• loss of access;

• business interruption;

• missed trades;

• delayed trades;

• execution errors; or

• losses resulting from third-party services.

You acknowledge that all trading decisions are made independently by you.

AORDS does not control your brokerage account or trade execution.

To the extent permitted by law, AORDS's aggregate liability arising from or relating to the Services will not exceed the total amount actually paid by you to AORDS during the three months immediately preceding the event giving rise to the claim.

This limitation does not apply to liability that cannot lawfully be limited.

21. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless AORDS and its owners, employees, contractors, and service providers from claims, liabilities, losses, expenses, or costs arising from:

• your unlawful use of the Services;

• your violation of these Terms;

• your infringement of third-party rights;

• your misuse of AORDS intellectual property; or

• your unauthorized distribution or resale of the Services.

22. Affiliates and Referrals

AORDS may operate an affiliate or referral program.

Affiliates are independent parties and are not employees, brokers, investment advisers, fiduciaries, or authorized representatives of AORDS.

Affiliates may receive compensation when users purchase qualifying AORDS products through an affiliate link.

Affiliates must not:

• guarantee trading profits;

• guarantee a particular win rate;

• claim that AORDS eliminates risk;

• fabricate performance results;

• make misleading income claims;

• falsely imply personalized financial advice;

• misrepresent the product; or

• misrepresent their relationship with AORDS.

23. Governing Principles and Applicable Law

These Terms will be interpreted in accordance with applicable law.

Where mandatory consumer-protection, privacy, or contractual laws apply to you and cannot lawfully be waived, those mandatory rights will continue to apply.

Nothing in these Terms is intended to exclude rights that cannot legally be excluded.

24. Changes to These Terms

AORDS may update these Terms from time to time.

If a change is material, AORDS may provide notice through:

• the website;

• email;

• the customer dashboard;

• the checkout platform; or

• another reasonable method.

The updated Terms become effective on the date stated at the top of the revised version.

Continued use of the Services after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.

25. Severability

If any provision of these Terms is found invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

26. Entire Agreement

These Terms, together with the Privacy Policy, Cookie Policy, Trading & Financial Disclaimer, and any additional terms displayed at checkout, constitute the agreement between you and AORDS concerning your use of the Services.
